Compensation claims

If you’re found liable for compensation, damages or costs in a civil court because of a problem with your advice or professional services, you’re covered – even if you’re not specifically aware that you are.

Design flaws, Loss causing advice Advice or Incorrect Specification

During your role as a professional adviser you are found to have made a mistake or been negligent in your duties your Professional Indemnity Cover, where covered, will pay for legal fees and conpensation.

Loss or Damage to Documents

If you lose or damage the belongings of clients or customers (i.e. stock, equipment, documents, or data), which are owned by a Third Party that are in your physical custody and control. A claim for a loss must arise where a third party has suffered some financial loss due to your negligence in storing of important documents.

Certification errors

If your profession involves providing certificates or validating of legal documents, cover can be provided for errors that have caused a loss, as a result of your negligence.

Fidelity Cover

Provides cover for loss of money and other property resulting from fraudulent or dishonest acts committed by an employee or volunteer.

Inadvertent Non-Disclosure

You will be covered if a client claims information is not presented and its found that such non-disclosure or misrepresentation was innocent and free from any fraudulent conduct or intent to deceive.

Arbitration, Expert Witness and Lecturing

You will be covered in respect of claims arising from their serving on committees, boards, tribunals, professional associations and the like or acting as expert witnesses or arbitrators or lecturers.

Legal Defence Costs

You will be covered for Defence Costs where such costs have been incurred. Such Defence Costs shall be payable in addition to the Limit of Indemnity.

Joint Ventures / Consortiums

Cover is provided for civil liability should you become legally liable to pay, whether jointly or severally, which arises out of the conduct of Professional Business, whilst a member of a joint venture or consortium.

Breach of Copyright or Confidence

Cover is provided in the form of financial support, if you are alleged to have used or taken or shared works created by someone else and past off as your own, or if you bring about a claim because a Third Party has infringed your Copyright.

Do I need professional indemnity insurance?

All businesses that enter into contracts with other businesses or third parties in general should consider professional indemnity insurance. While it’s not a legal obligation, your clients could make it a contractual requirements for you to hold a policy with certain limits, for a certain length of time after the project, to enter into business with you.

For some professional and trade bodies, it can be an eligibility requirement for membership.

All Professional Indemnity Insurance policies are different, and knowing how much cover you need is not always easy for you to know.

We can work with you to understand the type of projects you work on, and whether your clients, regulator or professional body ask you to have a minimum level of cover. You can usually choose between £50,000 and £5 million of professional indemnity insurance (more can be gained via what is known as an excess layer professional indemnity policy) and we place policies limits up to £100m and beyond.

Considerations you need to consider before committing to a professional indemnity policy:

  • Does your client(s) require you to have a minimum level of cover in place and is there a length of time you need to hold it for.
  • Consider the work you do and who for. Importantly, you need to consider how much of a financial impact a mistake in your line of work would cause. Your policy should have enough cover to full settle any claim and legal fees brought against you.
  • A professional indemnity policy can come in both an “aggregate” and “any one claim” basis. An ‘any one claim’ policy provides cover up to the full limit for each individual claim made in the period of insurance, whereas an ‘aggregate’ policy provides cover up to the full limit for all claims made in the period of insurance.

All businesses are different, so the professional indemnity cost to you will be different to the cost someone else would pay.

As a rule of thumb, businesses that face higher levels of risk will pay more.
