    IMPORTANT INFORMATION – YOUR DUTY TO MAKE A FAIR PRESENTATION OF THE RISK

    You must make a fair presentation of the risk to us at inception, renewal and variation of your Policy. You must therefore tell us about all facts and circumstances which may be material to the risks covered by your Policy in a clear and accessible manner or give us sufficient information to alert us of the need to make enquiries about such facts or circumstances.

    Material facts are those which are likely to influence the insurer in the acceptance of or assessment of the terms or pricing of your Policy. If you are in any doubt as to whether a fact is material, you should tell us about it.

    If you fail to make a fair presentation of the risk, the insurer may avoid your Policy (that is treat it as if it had not existed) and refuse to pay any claims where any failure to make a fair presentation is:

    1. deliberate or reckless; or

    2. of such other nature that, if you had told us about a material fact or circumstance, the insurer would not have issued, renewed or varied your Policy.

    In all other cases, if you fail to make a fair presentation of the risk, the insurer will not avoid your Policy but may instead:

    1. reduce proportionately the amount payable on any claim by reference to the ratio which the premium actually charged bears to the premium which they would have charged had you told us about a material fact or circumstance (e.g. if the insurer would have charged you double the premium, they will only pay half the amount of any claims under your Policy); and/or

    2. treat your Policy as if it had included such additional terms as they would have imposed had you told us about a material fact or circumstance. Payment of any claim you make will be subject to the application of any such additional terms.

    For these reasons it is important that you check all of the facts, statements and information set out in this form are complete and accurate. You must check with anyone you employ in your business that the facts and statements set out in this form are complete and accurate.

    You understand that any personal data provided by you to Jensten Insurance Brokers regarding yourself, your employees or agents shall be processed by Jensten Insurance Brokers, in compliance with the provisions of the Data Protection Act 2018 and any subsequent or amending legislation.

    Jensten Insurance Brokers may store your information on a computer and use it for administration, risk assessment, research and statistical purposes and for crime prevention. Jensten Insurance Brokers will only disclose your personal details to third parties if it is necessary for the performance of your contract with Jensten Insurance Brokers.

    In order to assess the terms of the insurance contract or administer claims that arise, Jensten Insurance Brokers may need to collect data that the Data Protection Act defines as sensitive, such as medical history or criminal convictions. By proceeding with this contract you will signify your consent to such information being processed by Jensten Insurance Brokers or agents of Jensten Insurance Brokers.

    Jensten Insurance Brokers will keep your information secure at all times. In certain circumstances, for example for systems administration purposes, Jensten Insurance Brokers may have to transfer your information to another country, which may be a country outside the European Economic Area (EEA). By proceeding with your insurance application, Jensten Insurance Brokers will assume you are agreeable for Jensten Insurance Brokers to transfer your information to a country outside the EEA.

    I/we declare that, after full enquiry, the contents of this proposal are true and that I/we have not misstated, omitted or suppressed any material fact or information. I/we agree that this proposal together with any other information supplied by me/us shall be incorporated into the contract if a policy is issued and have been relied upon by the insurer. If there is any material alteration to the facts and information which I/we have provided or any new material matter arises before the completion of the contract of insurance, I/we undertake to inform Underwriters.

    Who is the scheme designed for?

    The scheme has cover that has been specifically endorsed to provide protection and arbitration cover for members of IMPRESS. The cover can be further tailored to meet each member company’s individual needs with the flexibility to include or exclude additional coverage options as required.

    What Types of Work Does the scheme cover?

    Cover applies in whatever medium your material is published or broadcast including books, local and national newspapers, magazines, specialist journals, private publications, websites, TV, radio, video and film. Subject to EU Law, you are insured wherever in the world your work is published or distributed. Cover can be extended to include claims brought outside the EU, including USA/Canada, where you actively undertake or target work in those countries.

    The policy offers a wide range of covers including, as standard, protection for libel and slander, infringement of copyright, breach of confidentiality, negligence, breach of privacy, and liability to the public, as well as network security issues and transmission virus and cover for documents which are accidentally lost or damaged.                               Lloyd’s is proposing to transfer certain EEA insurance policies to Lloyd’s Brussels. The proposed transfer will not change terms and conditions of any policy, except that Lloyd’s Brussels will become the insurer and Data Controller in respect of the transferred policies.
